TERMS OF SERVICE - DON'S CUSTOM APPAREL

1. ACCEPTANCE OF TERMS
By accessing or using the Don's Custom Apparel website (www.DonsCustomApparel.com) or placing an order, you agree to be bound by these Terms of Service and all applicable laws and regulations.
If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. DEFINITIONS
• "We," "Us," "Our" refers to Don's Custom Apparel, a business operating in New York • "You," "Your," "Customer" refers to the person or entity placing an order • "Products" refers to custom apparel, stickers, cups, and other items sold by Don's Custom Apparel • "Services" refers to custom design, printing, and production services • "Site" refers to www.DonsCustomApparel.com
3. CUSTOM ORDERS & PRODUCTION
3.1 Made-to-Order Products
All products are made-to-order and customized specifically for each customer. Production begins after: • Design approval • Payment confirmation • Inventory allocation
3.2 Design Approval
• You will receive a digital mockup for approval before production • You are responsible for reviewing spelling, colors, placement, and all design details • Once approved, production begins and orders cannot be cancelled • We are not responsible for errors present in approved designs
3.3 Production Timeline
• Standard production: 5-7 business days from Official Production Start Date • You will receive an automated alert when your order hits our press • Production times may be extended during peak seasons • Rush production available for additional fee (contact us for pricing)
3.4 Bulk Orders (48+ Shirts)
• Require 100% prepayment before production • Cannot be cancelled once production begins • May require extended production time for very large orders • Contact us before placing bulk orders to discuss timeline
4. PRICING & PAYMENT
4.1 Pricing
• All prices are in U.S. Dollars (USD) • Prices are subject to change without notice • Pricing tiers are based on quantity ordered • Additional fees apply for 2XL/3XL sizes, back prints, sleeves, and premium options
4.2 Payment Methods
We accept: • Venmo (preferred - no fees) • Credit/Debit Cards • Shop Pay Installments (orders $35+) • Cash App • PayPal • Zelle
4.3 Payment Terms
• Payment is due at time of order • Bulk orders (48+ shirts) require 100% prepayment • Production does not begin until payment is received • We reserve the right to cancel orders with unpaid balances
4.4 Taxes
• Sales tax will be charged where applicable • Tax rates are determined by shipping destination • International customers are responsible for customs fees, duties, and import taxes
5. SHIPPING & DELIVERY
5.1 Shipping Methods
• Standard shipping: 3-5 business days after production • Expedited shipping: 1-2 business days after production • Local pickup available (Bay Plaza Shopping Mall, Bronx, NY)
5.2 Shipping Costs
• Calculated at checkout based on weight, size, and destination • Free shipping on US retail orders over $100 (standard shipping only) • Free shipping does NOT apply to:
- International orders (customer pays actual shipping costs)
- Custom orders or wholesale/B2B orders (customer pays actual shipping costs)
- Expedited shipping
5.3 Delivery
• We are not responsible for shipping delays caused by carriers, weather, or other factors beyond our control • Risk of loss passes to customer upon delivery to carrier • Customer is responsible for providing accurate shipping address
5.4 International Shipping
• Available to most countries • Customer is responsible for ALL international shipping costs • Free shipping promotions do NOT apply to international orders • Customer is responsible for all customs fees, duties, and import taxes • Delivery times vary by country (typically 10-21 business days)

6. REFUNDS & RETURNS
6.1 No Refunds on Custom Products
• All sales are final once production begins • Custom products cannot be returned or exchanged • Orders cannot be cancelled after design approval and payment
6.2 Exceptions
We will issue refunds or replacements for: • Defective products or manufacturing errors • Our mistakes (wrong design, wrong product, wrong quantity) • Products damaged during shipping (with photo proof within 7 days)
6.3 What Is Not Eligible
• Customer design errors in approved mockups • Wrong size ordered by customer • Change of mind after production begins • Normal color variations between screen and print • Lost or stolen packages after delivery

7. INTELLECTUAL PROPERTY
7.1 Customer-Provided Designs
• You represent that you own or have rights to use any designs, logos, or images you provide • You are responsible for obtaining necessary permissions, licenses, or rights • You agree to indemnify us against any claims of copyright or trademark infringement
7.2 Our Designs
• Designs created by Don's Custom Apparel remain our intellectual property • You receive a license to use the design on ordered products only • You may not resell, reproduce, or distribute our designs without permissionnull7.3 Prohibited Content

8. LIMITATION OF LIABILITY

• Our liability is limited to the purchase price of the product • We are not liable for indirect, incidental, or consequential damages • We are not responsible for how products are used after delivery
8.2 Service Interruptions
• We are not liable for website downtime, technical issues, or service interruptions • We reserve the right to modify or discontinue services without notice
8.3 Third-Party Services
• We are not responsible for third-party payment processors, shipping carriers, or other services • Issues with third-party services should be directed to those providers
9. PRIVACY & DATA
• We collect and use personal information as described in our Privacy Policy • We do not sell or share customer information with third parties (except as required for order fulfillment) • Payment information is processed securely through third-party payment processors

10. DISPUTE RESOLUTION

• Filing a chargeback without contacting us first may result in account suspension • We will provide all documentation to dispute invalid chargebacks

11. ACCOUNT & SECURITY
11.1 Account Creation
• You may create an account to track orders and save information • You are responsible for maintaining account security • You must provide accurate and current information
11.2 Prohibited Activities
You may not: • Use the site for illegal purposes • Attempt to hack, disrupt, or interfere with the site • Impersonate others or provide false information • Violate any applicable laws or regulations
12. MODIFICATIONS TO TERMS
